By using Swimgen you are agreeing to be bound by the following terms and conditions. If you do not agree with these terms and conditions, you may not use Swimgen.
Blue Geyser Software reserves the right to update and change the Terms of Service from time to time. Paying customers will be notified via the email on record, all other users will not be notified.
You are responsible for the security of your account. Blue Geyser Software is not responsible for any loss or damage caused by your negligence.
You are responsible for all reports, logos, and other content uploaded through your account.
You are responsible for securing the rights to use all curriculum materials including but not limited to level names, skill requirements, and logos that you provide to Swimgen for the purposes of reporting.
You may not use Swimgen for illegal or unauthorized purposes including but not limited to violation of copyright or trademark laws.
The service is billed monthly based on the total number of report cards that were created and not deleted.
Invoices are delivered quarterly through email on the first of January, April, July, and October.
To prevent customers from paying foreign exchange fees on credit card payments, customers in the United States will be billed in USD, while customers in Canada will be billed in CAD.
If payment is not received in full within 30 days of receiving the invoice, Blue Geyser Software reserves the right to disable report retrieval until payment is received.
You can terminate your account at any time by email. Please indicate wether you would like all existing reports to remain online or not.
A final invoice will be created to account for all unbilled reports.
Your use of the Service is at your sole risk. The service is provided on an “as is” and “as available” basis.
Technical support is only provided to paying account holders and is only available via email. Support is only available in English.
You understand that Swimgen uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
